What should I be aware of when reporting tax in Germany?

  • The tax year is from 1 January to 31 December.
  • The tax return is submitted electronically.
  • The deadline for filing the return is 31 July. If a certified tax adviser prepares the income tax return, the filing deadline can be extended until 28 (or 29) February of the following year.
  • The reporting currency is Euro (EUR).
  • The reporting language is German (DE).

What does the German tax office (BZSt) consider taxable?

  • Income: Dividend income, interest income, and other investment income.
  • Capital Gains: Capital gains from securities and derivatives. Capital gains from cryptoassets or coins and metals only in case the holding period is less than one year.

How are capital gains calculated in Germany?

The capital gain/loss on an asset can be calculated by subtracting the cost basis (purchase price) and any associated fees of an asset from the value of the asset when it was sold.

If many positions are held on the same asset, bought at different prices, there are several methods for working out the cost basis. In Germany, the method used varies based on the type of asset.

  • For securities, the ‘first in, first out’ (FIFO) method is used.
  • For CFDs, specific lot identification is used.

Why are the capital gains between the etoro account statement and the tax report different?

You may notice differences between your etoro account statement and your etoro tax report. These can be attributed to the different methods used to calculate capital gains.

  • Account statement reporting method: Specific lot identification
  • Tax report reporting method:
  • For securities: First in, first out (FIFO)
  • For CFDs: Specific lot identification

Additionally, to calculate the financial data presented in the tax report, the values of the positions are converted from USD to EUR at the time of position opening and closing using the exchange rate at the time of closure. This conversion process may result in a further difference in the end value between the account statement and the tax report.

What are the required German tax forms and where can I download them?

Form Anlage KAP - for income from capital assets

  • Summarises foreign/domestic income and capital gains that have not been subject to tax deduction.
  • Covers all instruments (shares, bonds, derivatives, etc.) except for funds and income/capital gain from private sale transactions such as for coins/metals, FX or cryptoassets.

Form Anlage KAP-INV

  • Investment fund income and capital gain.
  • Fund distributions, advanced lump sums, and disposal of investment units that have not been subject to domestic tax deductions.

Form Anlage SO

  • Income from private sales transactions.
  • Income or sale proceeds from cryptoassets, coins/metals or FX transactions. The individual tax rate of up to 45% is applied to this income.

All these forms can be downloaded from the Income Tax 2023 folder on the German tax office's (BZSt) website.

etoro does not provide the certificate of loss (Verlustbescheinigung), as we are not a German financial institution and therefore are not subject to German withholding tax rules.

Clients should speak with a tax professional on how to manually claim losses via the Anlage KAP in their annual German personal income tax return.

Can I use the etoro tax report as a basis for filling out official tax forms?

The etoro tax report may be used as a basis for completing certain sections of the official form.

In the etoro tax report, the relevant form and line (Zeile) where the information should be entered are written in brackets to aid in filling out the official forms.
