What should I be aware of when reporting tax in Poland?

  • The tax year is from 1 January to 31 December.
  • The tax return can be submitted both electronically and in paper format.
  • The reporting currency is the Polish złoty (PLN).
  • The reporting languages are Polish (PL) and English (EN).
  • The deadline for filing the return in paper format is 30 April.
  • The earliest submission date is 15 February. This deadline applies to the following tax return forms: PIT-37, PIT-36, PIT-36S, PIT-36L, PIT-36LS, PIT-38 and PIT-39.
  • PIT forms may be submitted online using:
  • An interactive PDF file
  • The e-Deklaracje Desktop application
  • ‘Your e-PIT’ service (for forms PIT-28, PIT-36, PIT-36L, PIT-37 and PIT-38).

What does the Polish National Revenue Administration consider taxable?

  • Capital income: Dividends, interest income, other income.
  • Capital Gains: Capital gains from disposals of different asset types (ETFs, shares, CFDs, crypto).

How are capital gains calculated in Poland?

The capital gain/loss on an asset can be calculated by subtracting the cost basis (purchase price) and any associated fees of an asset from the value of the asset when it was sold.

If many positions are held on the same asset, bought at different prices, there are several methods for working out the cost basis. In Poland, the ‘first in, first out’ (FIFO) method is used.

Why are the capital gains between the etoro account statement and the tax report different?

You may notice differences between your etoro account statement and your etoro tax report. These can be attributed to the different methods used to calculate capital gains.

  • Account statement reporting method: Specific lot identification
  • Tax report reporting method: FIFO

Additionally, to calculate the financial data presented in the tax report, the values of the positions are converted from USD to PLN at the time of position opening and closing. This conversion process may result in a further difference in the end value between the account statement and the tax report.

What are the required Polish tax forms?

  • PIT-11: Information about income obtained from your employer (for employees).
  • PIT-37: For individuals working under an employment contract or civil law contract.
  • PIT-36: For individuals conducting business activity or settling losses from previous years.
  • PIT-28: For taxpayers taxed with a lump sum.
  • PIT-38: For individuals receiving income from the sale of securities.
  • PIT-39: For individuals from private real estate sales.
